TERMS AND CONDITIONS OF USE OF THE WATZEAT PLATFORM

These Terms and Conditions of Use of the WatzEat Platform ("Terms”) govern access to and use of the WatzEat web platform, available at [https://www.watzeat.com] ("Platform”), operated by Braveplateau, Lda., VAT PT517402181, headquartered at Rua João de Barros, No. 90, Block A, Ground Floor, Left, 4150-414 Porto, trading under the name "WatzEat”.

The User must carefully read and accept the Terms before accessing and using the Platform.

1.     Platform

1.1.   WatzEat is a web platform that allows Users to order food and beverages ("Product(s)") from local restaurants ("Partner(s)").

1.2.   Products may be ordered for take-away and/or home delivery, depending on the options provided by each Partner.

1.3.   The Platform acts as an intermediary between Partners and Users, facilitating communication and order processing. The service includes viewing menus, selecting Products, making payments, and tracking the order status.

2.     Registration and Customer Account

2.1.   Full access to the Platform requires creating a WatzEat customer account. After the User first contacts WatzEat via its WhatsApp channel (+351968505650), a unique, time-limited link will be sent to create an account. WatzEat uses the User's WhatsApp data (name and number) as login credentials. Upon clicking the link, the User must confirm account creation, acceptance of the Terms, and Privacy & Cookie Policies. Without this confirmation, no account is created and no data is stored.

2.2.   Each time the User interacts with WatzEat’s WhatsApp channel, the system checks the WhatsApp data against its database. If the data matches, the User receives a unique login link. If not, the process in clause 2.1 applies again.

2.3.   Users must provide true and accurate information. Responsibility for account security and WhatsApp credentials lies with the User.

2.4.   The User may request deletion of their account and data at any time per WatzEat’s Privacy Policy.

2.5.   WatzEat reserves the right to suspend or delete accounts exhibiting fraud or violation of these Terms.

3.     Orders

3.1.   Users can view menus, select Products, and confirm orders by payment. Once paid, the Partner processes and confirms the order.

3.2.   Products with age restrictions (e.g., alcohol) are only sold to users 18+. WatzEat or Partners may verify age and refuse delivery if unverified—no refund applies in that case.

3.3.   Preparation and delivery times are estimates. WatzEat is not liable for delays due to external factors.

3.4.   Order status updates are sent via WhatsApp or, if available, email.

4.     Prices and Payment

4.1.   All prices on the Platform include VAT. Additional fees (e.g., delivery) are determined by the Partners and shown before checkout.

4.2.   Available payment methods may include MBWay, MB reference, credit/debit cards, Google Pay, and Apple Pay, depending on Partner acceptance.

4.3.   Users must ensure payment info is accurate and funds are sufficient. WatzEat is not responsible for payment provider failures. Orders will not be processed if payment fails.

5.     Cancellation and Refunds

5.1.   Users may cancel an order before it is confirmed by the Partner without additional cost. Once confirmed, cancellation may incur fees depending on status.

5.2.   If the Partner cannot fulfill an order, partial or full refunds may be issued. Complaints should be made to the Partner or to WatzEat within 24 hours via the contact form.

6.     Promotions and Offers

6.1.   WatzEat may offer discounts and promotions. Terms will be shown on the Platform. Users are responsible for meeting those terms.

7.     Access to the Platform

7.1.   Users are responsible for the devices, internet access, and updates required to use the Platform. WatzEat is not liable for issues caused by hardware/software failures or external factors.

8.     Usage Restrictions

8.1.   Users agree to use the Platform legally and responsibly. Fraudulent use, multiple account abuse, illegal content, or disruptive behavior is strictly prohibited.

8.2.   WatzEat may block access and pursue civil or criminal action in the event of violations.

9.     Liability Limitation

9.1.   WatzEat is only an intermediary and is not responsible for Product quality or delivery punctuality.

10.     Intellectual Property

10.1.   All intellectual property on the Platform belongs to or is licensed to WatzEat.

11.     Personal Data

11.1.   WatzEat protects User privacy and complies with the General Data Protection Regulation (GDPR). See our Privacy and Cookie Policies for more information.

12.     WhatsApp Usage

12.1.   Platform access occurs via WhatsApp, so Meta's Terms of Service may also apply. WatzEat is not responsible for changes to Meta's terms.

14.     Governing Law and Jurisdiction

Portuguese law governs these Terms. Any disputes will be submitted to the Civil Court of the District of Porto.

For disputes regarding goods/services, consumers may contact CICAP: www.cicap.pt or see ANACOM and DGC.

16.     Updates and Modifications

WatzEat may modify these Terms at any time with prior notice. Continued use of the Platform requires accepting the updated Terms.
