TERMS AND CONDITIONS OF USE OF THE WATZEAT PLATFORM
These Terms and Conditions of Use of the WatzEat Platform ("Terms”) govern the access to and use of the web platform WatzEat, available at [https://www.watzeat.com] ("Platform”), operated by Braveplateau, Lda., NIPC 517402181, headquartered at Rua João de Barros, No. 90, Block A, Ground Floor, left 4150-414 Porto, operating under the trade name "WatzEat”.
The User must carefully read and accept the Terms before accessing and using the Platform.
1. Platform
1.1. WatzEat is a web platform that allows Users to order food and beverage products ("Product(s)”) from local restaurants ("Partner(s)”).
1.2. The Products may be ordered for takeaway and/or home delivery, depending on the options provided by each Partner.
1.3. The Platform functions as an intermediary between Partners and Users, facilitating communication and the processing of orders. The intermediation service includes viewing menus, selecting Products, making payments, and tracking order status.
2. Registration and Customer Account
2.1. Full access and use of the Platform depend on creating a WatzEat customer account. After the User’s first contact with WatzEat, made through WatzEat’s WhatsApp channel – available at +351968505650 – the User will automatically receive a unique, time-limited link to create the account. In this initial interaction, WatzEat temporarily collects the User’s WhatsApp-registered data – i.e., phone number and Username – which will later be used as credentials to create the customer account. Upon entering the Platform using the link, the User will see a pop-up requiring them to confirm acceptance of account creation using the WhatsApp credentials, and to read and accept these Terms and Conditions, as well as the Privacy and Cookie Policies. Use of the Platform is limited until these confirmations are given. A WatzEat account will only be created after the User validates all the above. If the User refuses any of these points, no account will be created, their data will not be stored in any database, and no login will occur on the Platform. Access will remain limited to a non-logged-in user, and it will not be possible to place orders through the Platform. Once the account is created, login to the Platform will always be done via WhatsApp, using the dedicated WatzEat channel mentioned in clause 2.1.
2.2.Each time the User interacts with WatzEat’s WhatsApp channel, their WhatsApp-registered data (as defined in clause 2.1) will be collected by WatzEat. These data will be cross-checked with the WatzEat user database. If the data already exists, the User will be recognized and sent a unique, time-limited link via WhatsApp message to access the Platform. This exclusive link contains the access credentials, allowing automatic login, so no additional login is required. If the data does not exist in the database, the User will be considered new and the conditions outlined in clause 2.1 apply.
2.3. Each time the User interacts with WatzEat’s WhatsApp channel, their data registered on WhatsApp (as identified in clause 2.1) will be collected by WatzEat. This data will be cross-referenced with WatzEat’s user database. If the data already exists in the database, the User will be recognized and will receive a unique, time-limited link via WhatsApp message to access the Platform. This link, exclusive to the User, contains the access credentials to the Platform, allowing automatic login, so the User will not need to perform any login to access and use the Platform. If the collected data is not yet in WatzEat’s database, the User will be considered a new user of the Platform. In this case, the conditions defined in clause 2.1 apply.
2.4. Whenever applicable, the User agrees to provide true, complete, and accurate information. The User is responsible for the confidentiality of their WhatsApp credentials and for the protection of their account.
2.5. The User may, at any time, request the deletion of their account and respective data, in accordance with WatzEat’s Privacy Policy.
2.6. WatzEat reserves the right to suspend or delete accounts that display fraudulent behavior or violate these terms.
3. Orders
3.1. Through the Platform, Users can access the Partners’ menus and select the desired Products. After selection, the User must add the Products to the cart and confirm the order through payment. Once payment is made under the terms of clause 4, the order will be processed by the Partner, who will confirm it.
3.2. Products subject to age restrictions (namely, alcohol) may only be sold and delivered to individuals aged 18 or over. By ordering one of these Products, the User confirms that they are at least 18 years old. WatzEat and/or the Partner may apply additional measures to verify age and reserve the right to refuse delivery if the individual refuses to provide proof of age. If, at the time of delivery, the Product is refused due to failure to verify the person’s age, the User will not be entitled to a refund for that Product.
3.3. The preparation and delivery time is estimated and may be affected by various external factors, such as product availability or the number of simultaneous orders to the same Partner. WatzEat does not guarantee the accuracy of these timeframes.
3.4. Notifications regarding the status of orders will be sent via WhatsApp. If the User has provided their email address, these notifications may also be sent by email.
4. Prices and Payment
4.1. All prices shown on the Platform include VAT at the applicable legal rate. Additional fees may apply, namely delivery fees. The prices listed on the Platform, as well as the application of any additional fees, are determined exclusively by the Partners. The User will be duly informed of the application of any additional fees before proceeding with payment.
4.2. The User must select the payment method to be used. In general, the following payment methods are available on the Platform: MB Way, Multibanco reference, Debit/Credit Card, Google Pay, and Apple Pay. However, each Partner may not accept all the payment methods listed here, and in such cases, the User will only be able to select one of the payment methods made available by that Partner. The applicable payment method options for each Partner will be duly provided to the User prior to payment.
4.3. The User is responsible for providing accurate payment information and ensuring they have sufficient funds to complete the transaction. WatzEat is not liable for any failures or errors arising from payment service providers. If the User’s funds are not validated as available, preventing the order from being paid, the order will not be submitted.
5. Cancellation and Refunds
5.1. The User may cancel the order at any time before it is confirmed by the Partner, without additional charges. After the order is confirmed, cancellation is no longer possible through the platform and can only be carried out by direct contact between the User and the Partner. Such cancellation may be subject to fees, depending on the status of the order, and is the sole responsibility of the Partner.
5.2. If an order cannot be delivered due to operational issues on the part of the Partner, namely due to lack of Products, a partial or full refund may be issued, as applicable. The User should report any issues with the order directly to the Partner using the contact details provided on the Platform. Alternatively, and within a maximum of 24 hours after delivery, the User may report any issues to WatzEat so that WatzEat can assess the situation and, if applicable, issue a refund. Contact with WatzEat must be made through the contact form available on the Platform.
6. Promotions and Offers
6.1. WatzEat may offer promotions, discount coupons, or temporary offers. The conditions for using these promotions will be disclosed on the Platform. The User must ensure that they meet the stipulated conditions to benefit from any promotion or offer. WatzEat is not responsible for any failure by the User to meet the promotion requirements.
7. Access to the Platform
7.1. The User must ensure they have the necessary devices, updates, and internet connection to access and use the Platform. WatzEat is not responsible for failures in the User’s hardware or software (e.g., equipment issues, interruptions, etc.), nor for incidents caused by external factors, such as failures in telephone, computer, electrical, or natural (weather, climate, etc.) networks, or poor performance by the companies providing those services that prevent the use of the Platform.
8. Restrictions on Use
8.1. The User agrees to use the Platform in a legal and responsible manner, in accordance with Portuguese law and these terms. Users are prohibited from falsifying information, placing false or fraudulent orders, creating multiple accounts to improperly benefit from promotions, attempting to bypass any Platform restrictions, or using the Platform for unlawful purposes or in ways that interfere with its operation. It is also prohibited to introduce content into the Platform that is obscene, offensive or derogatory, discriminatory, violent or inciting violence, hatred, or any illegal activity; political, union-related, or religious content; or content that, in general, violates human dignity or public order, or that aims to infect, corrupt, disrupt, or otherwise harm the functioning of the Platform.
8.2. In the event of a breach of these Terms, WatzEat reserves the right to suspend or block the User’s access to the Platform without prior notice. WatzEat also reserves the right to take any civil or criminal action deemed necessary or appropriate to protect its rights.
9. Limitation of Liability
9.1. WatzEat acts solely as an intermediary between Users and Partners. WatzEat is not responsible, in particular, for the quality of the Products or the timeliness of order deliveries.
10. Intellectual Property
10.1. All intellectual property rights related to the content available on the Platform are owned by WatzEat or are duly licensed to WatzEat.
11. Personal Data
11.1. WatzEat is committed to ensuring the privacy and security of Users’ personal data. All personal data collected will be processed in accordance with the General Data Protection Regulation. 12. Use of WhatsApp
12.1. Access to the Platform is carried out through WhatsApp, and therefore Meta’s Terms of Service may also apply. WatzEat does not control nor is it responsible for any changes or modifications to Meta’s Terms of Service and recommends that the User read Meta’s terms and privacy policies to understand how their data is used by Meta.

14. Governing Law and Jurisdiction
14.1. The use of the Platform is governed by Portuguese law.
14.2. Any issue or dispute arising from the application, interpretation, integration, or enforcement of these terms, when not resolved by mutual agreement, shall be submitted to the Civil Court of the District of Porto.
14.3. If any provision of these Terms is found to be null or unenforceable, the remaining provisions shall remain in full force and effect.
15. Alternative Dispute Resolution
15.1. In the event of a dispute regarding the supply of goods, the consumer may resort to a Consumer Alternative Dispute Resolution Entity. The competent entity for this purpose is: Centro de Informação de Consumo e Arbitragem do Porto (CICAP), www.cicap.pt.

16. Updates and Modifications
16.1. WatzEat reserves the right to modify or update these terms at any time, with prior notice to Users. The changes take effect once the User accepts the new Terms. To continue using the Platform, the User must accept the updated Terms.
